These Terms & Conditions (“Terms”) govern access to and use of the Nexyva AI website and services. By accessing or using our services, you agree to these Terms. If you are using the service on behalf of a business, you represent that you have authority to accept these Terms for that business.
1. Our Services
Nexyva AI provides AI-powered receptionist and business automation services, which may include AI voice agents, call handling, appointment assistance, customer communication and related tools. Specific features, limits and availability depend on the plan or service configuration selected by the customer.
2. Account and Business Information
You are responsible for providing accurate information needed to configure your service and for keeping account credentials secure. You must promptly notify us of unauthorised access or other security concerns.
3. AI-Generated Responses
Our services use artificial intelligence. AI-generated responses may occasionally be incomplete, inaccurate, misunderstood or inappropriate. Customers should configure and monitor their AI agent appropriately and should not rely on the service as a substitute for professional legal, medical, financial or other regulated advice.
4. Customer Responsibilities
You are responsible for the information, instructions, services, prices, business hours, policies and other content you provide for your AI agent. You must ensure that your use of the service complies with applicable laws and does not infringe the rights of others.
5. Calls, Recording and Consent
If your configuration records, transcribes or otherwise processes calls, you are responsible for providing any legally required notices and obtaining any required consent from callers or other participants. You must not use Nexyva AI to conduct unlawful, deceptive, abusive or unauthorised communications.
6. Prohibited Uses
You must not use the service for unlawful activities, fraud, impersonation, harassment, spam, malicious activity, unauthorised surveillance, or communications that violate applicable laws or third-party rights. We may suspend or restrict use where reasonably necessary to protect users, our systems or third parties.
7. Third-Party Services
Our services may depend on third-party providers for telephony, AI processing, hosting, payments and other infrastructure. Third-party services may have their own terms, limitations, pricing or availability. Changes or outages at a third-party provider may affect service availability.
8. Fees and Billing
Applicable subscription, usage, setup or other fees will be communicated to the customer before purchase or activation. Unless otherwise stated in writing, customers are responsible for applicable charges incurred through their account. Taxes may apply where required by law.
9. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. Service may be temporarily unavailable because of maintenance, network failures, third-party outages, technical issues or circumstances beyond our reasonable control.
10. Intellectual Property
Nexyva AI and its branding, website design, software, documentation and related materials are owned by or licensed to Nexyva AI unless otherwise stated. Customers retain ownership of content and business information they provide, subject to the rights needed to operate the service.
11. Suspension and Termination
We may suspend or terminate access where a customer materially breaches these Terms, fails to pay applicable fees, uses the service unlawfully, creates a security risk, or where suspension is reasonably necessary to comply with legal or third-party requirements.
12. Disclaimers
To the extent permitted by applicable law, the service is provided on an “as available” basis. We do not guarantee that AI responses will always be accurate, complete or suitable for every business situation.
13. Limitation of Liability
To the extent permitted by applicable law, Nexyva AI will not be responsible for indirect, incidental, special or consequential losses arising from use of the service. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be published on this page with a revised effective date. Continued use of the service after an update may constitute acceptance of the updated Terms to the extent permitted by law.
15. Governing Law
These Terms are governed by the laws of India. Any dispute arising from these Terms or the use of the service will be subject to the jurisdiction of the competent courts in India, after the parties first try in good faith to resolve it through discussion.
